    The details like List Price of the book, Percentage of discount, Net Price of the book and Expected date of delivery from date of closing of this tender are required while submitting the quotation of the book.

    Please note that the Quotation should be signed by an authorized signatory of the vendor with full name, status and signature along with the official seal of the firm and addressed to the Chairperson (PGP), IIM Calcutta. Name of the titled book should be mentioned on the envelope.

    The Books should be delivered at free of freight charges at the Institute preferably during working hours and the Vendors will have to compulsorily submit chalan bearing details of the book at the time of the delivery. Penalty will be imposed for failure of delivery on time. The excess copy of the above book will have to be taken back from the Institute.

    Sealed quotations are invited from firms having good experience and credential in carrying out similar work for Convocation of an academic Institute like IIMs, IITs, University etc., for construction and associated work of aesthetically designed AC Shamiana. The quotation is required to be submitted in a sealed cover to the Senior Administrative Officer (Purchase) duly super-scribing “Tender for Construction of AC Shamiana for Convocation – 2017” on the top cover.

    Last Date for submission of tender: 24.01.2017 at 2.00 p.m.

    The sealed quotation along with cost of the tender document of Rs.1,000/- and EMD of Rs.50,000/- in Demand Draft each in favour of ‘Indian Institute of Management Calcutta’, payable at Kolkata and other support documents as mentioned in the terms & conditions must reach the Office of the Senior Administrative Officer (Purchase), Indian Institute of Management Calcutta, D.H. Tenderers should read the terms & conditions and the scope of work carefully and comply with the instructions strictly while submitting their tenders.

    TERMS & CONDITIONS:

    1. Sufficient man-power should be available for proper erection of AC Shamiana. Technical manpower should also be provided to ensure safety of erected pandal etc. and proper electrical connections to be made so as to avoid any hazard due to the work entrusted with the contractor. All electrical joints must be properly insulated so as to avoid any short circuiting and fire. Firms/agencies having past experience of making arrangement for convocation / similar events shall be given preference.
    2. The contractor will be responsible for transportation of all materials related to his/her and no extra payment will be made by IIM Calcutta on this account.
    3. The contractor himself will be responsible for safety and security of his material and IIM Calcutta will not be responsible for any damage/theft of material of the contractor.
    4. For any emergency situation, the contractor will provide solution related to his/her work at no extra cost.
    5. All material to be used should be of very high quality. For the material to be used, which is not of good quality, appropriate deductions will be made from the bill. In case, it is found at some stage that the quality of goods supplied is inferior, the contract will be cancelled and the firm will be black-listed.
    6. The structures should be strong enough to withstand mild cyclone and rain.
    7. All structures materials are to be dismantled and fully removed within 7(seven) days after the programme and the ground to be cleaned up to the satisfaction of IIM Calcutta.
    8. Necessary cleaning, dressing and levelling of ground and approach roads to the pandal are to be carried out without extra cost.
    9. As the convocation is an important function of the Institute, timely completion of work and high quality material would be the deciding factor in award of work. A Committee in this regard may inspect material to be used before award of work.
    10. All works related to the convocation should be completed by 28th March, 2017 so that any modification /alteration can be made in time. Convocation is scheduled on 1st April, 2017.
    11. Before quoting the rates, the firm shall be advised to inspect the site and working conditions thereof.
    12. The successful bidder shall be responsible for full execution of the contract and shall not in any case assign or sub-let ordered items or part thereof to any other party. Failure to do so will attract cancellation of the order.
    13. All works related to this tender should be completed to entire satisfaction of the IIM Calcutta, failing which IIM Calcutta will have right to cancel the work order and no payment will be made in that case.
    14. Any defect found in the work carried out by the contractor will have to be rectified free-of-cost by the contractor.
    15. All precautionary/safety measures should be adopted by the firm in erecting hangers, tents, fixing lights etc. The Institute shall not be responsible for any mishappening and loss caused due to the firm’s negligence.
    16. The contractor shall take all necessary precautions to ensure safety and security of their workmen and shall be responsible for any injury that might occur to person/s and bear all cost towards treatment/compensation of them. The contractor shall have to comply with the provisions of all prevailing Labour Laws relating to the work assignment.
    17. The contractor shall take all necessary precautions to prevent any damage that may cause towards any Institute’s property during the course of execution of the contract and they will be liable to make good the same at their cost.
    18. Penalties: In the event of the contractor failing, declining, neglecting or delaying the supply or in the event of any damage occurring or being caused by the contractor, IIM Calcutta shall without prejudice to any other party remedy available to it under the law for the time being in force in the state of West Bengal.
      1. Terminate the work order at the risk and cost of the bidder whose quotation has been accepted and
      2. Recover the amount of loss caused by the damage, failure or default (including the consequential damage).
      3. Impose a penalty up to 10% of the total value of the order and confiscate the Earnest Money.
      4. The delay in the supply and imposition of penalty shall be subject to “Force Majeure” and “Arbitration” clauses of the contract.
    19. Cost of tender document: Rs.1,000/- (Rupees one thousand) only in the form of Demand Draft drawn in favour of ‘Indian Institute of Management Calcutta’, payable at Kolkata shall be enclosed with the quotation, otherwise tender will not be accepted.
    20. Earnest Money Deposit (EMD) of Rs.50,000/- (Rupees fifty thousand) only in the form of Demand Draft drawn in favour of ‘Indian Institute of Management Calcutta’, payable at Kolkata shall also be enclosed with the quotation/tender. EMD of the successful bidder will be kept as Security Deposit and will be returned without any interest within 30 working days after completion of the work. EMD of the unsuccessful bidders will be returned within 30 working days after issuance of the work order.
    21. The representatives of the firm should be available on telephone and also on mobile to enable this Institute to call them in emergency situation. Therefore, telephone as well as mobile number(s) need to be provided to IIM Calcutta.
    22. Each page of the tender is to be signed by the tenderer and duly stamped.
    23. All disputes arising out of this contract shall be referred to the sole arbitration of the Director, IIM Calcutta. The venue of arbitration shall be in Kolkata only.
    24. IIM Calcutta reserves the right to reject any or all tender(s) without assigning any reason. The decision of IIM Calcutta in this regard shall be final. No enquiries in this regard shall be entertained. Correspondence during tendering process may invite disqualification.
    25. The firm should be a registered firm with Trade & Taxes/Sales Tax/ Service Tax etc. and should possess PAN, TIN(VAT)/Sales tax and service tax as applicable, copies of which must be enclosed.
    26. All quoted rates will remain valid for a period of 30 days from the date of opening of price bid. Work should be completed within the specified date from the date of issue of the Letter of Intent /Work Order.
    27. Rates of all items should be inclusive of supply of material labour charges, hire charges of tools & tackles, scaffolding, plant & machinery any taxes and duties etc.
    28. The rates quoted by the bidder shall be inclusive of all taxes, duties, transportation charges and other statutory payments and will not subject to any fluctuation due to any increase in any effect.
    29. Income tax deduction will be made at source from all payment as per laid down rules of Ministry of Finance. The PAN number of the contractor should be clearly mentioned in the bills.
    30. This work contract may be given to the successful bidder for Convocation- 2018 with same terms and conditions subject to satisfactory service and performance of Convocation -2017 and requirement of the Institute in future.
    31. The detailed Scope of Work is enclosed in Annexure- I.
    32. Special discount/rebate admissible to Educational Institute like IIMs/IITs may be specifically indicated in the quotation.
    33. No conditional terms are acceptable from the bidder’s end.

    Annexure- A. Bidder’s Pre qualification Criterion

    3 Bidder should have 10 valid OEM certified Level 3 engineers posted in the offices in India.
    4 Bidder must have support office/ 24x7 help desk at Kolkata for service support
    5 Bidder should have a spare depot in Kolkata
    6 Highest level / tier of partnership with OEM for active components in the last 3 years.
    7 Bidder should be ISO 9001:2000 or ISO 27001 or ISO 20,000 certified.
    8 Average Annual Turnover in the last 3 financial years (2013-14, 2014-15, 2015-16) has to be at least 100 crores
    9 Profitable annual financial turnover over a period of last 3 years, according to the audited Balance Sheet.
    10 Bidder should supply Manufacturer Authorization Format (MAF) from the OEM

    Sealed tenders in two bid system (two separate envelopes - one for techno-commercial bid and the other for price bid) are invited from bona fide and experienced vendors having adequate credential in similar nature of work for the following jobs:

This may be obtained on any working day between 10-00 a.m. and 4-00 p.m. from the office of the Computer Centre on payment of non-refundable tender fee of Rs 2500/- (Rs Two Thousand Five Hundred only) by demand draft in favor of Indian Institute of Management Calcutta and payable at a Bank in Kolkata. Bidders need to purchase the tender to participate in the pre-bid meeting.

    Sealed tenders are invited from reputed Company/contractors/supplier of Diesel Generating Set having adequate experience in the business for providing 1(one) 100 KVA sound proof Diesel Generating Set in good condition, on hire basis, for the Academic Block of IIM Bodh for a period of one year which may further be extended, if required.

    The scope of services and terms & conditions for hiring the D.G. Set are as under:

    1. Rate is to be quoted for monthly rental charges for 100 KVA sound proof D.G. Set (one No) complete with all accessories on hire basis and round the clock services of the operator possessing the requisite & valid electrical license, for running the D.G. Set. The rate is exclusive the cost of fuel which will be paid extra after submission of the claim bill. The rate should be inclusive of delivery and installation charges at IIM Bodh Gaya.
    2. All cost for maintenance and servicing of the Generator including the cost of spare parts and periodical replacement of Engine oil are to be borne by the Generator provider.
    3. The tender should remain valid for a period of 90 (ninety) days from the date of opening.
    4. The D.G. Set should be maintained properly to keep the same in satisfactory running condition at all times for supplying emergency power to the extent of 100 KVA.
    5. EMD (Earnest Money Deposit): Interested vendors may put bid document, complete in all respects along with Earnest Money Deposit (EMD) amounting to 2% of the quoted value by Demand Draft in favour of Indian Institute Of Management Bodh Gaya, payable at Kolkata and other requisite documents in the Tender Box kept in the Office of Senior Administrative Officer (Purchase) located in Administrative Building, East Side (Ground Floor), Indian institute of Management Calcutta, Joka, Kolkata – 700104. Tender received without EMD will be rejected straightaway. The EMD of selected bidder will be kept as Performance Security Deposit till end of the contract. EMD of rest bidders will be released, preferably within 30(thirty) working days from the opening of the bid without any interest.
    6. The arrangements for providing accessories like cables, change-over switches, Energy meter, construction of foundation etc., if required any, shall be made by the supplier/contractor.
    7. The charges for transportation, loading & unloading of the D.G. Set for installation of the same at Indian Institute of Management Bodh Gaya premises, as identified by the Indian Institute of Management Bodh Gaya, will be borne by the supplier/contractor.
    8. The successful bidder should be in a position to install and commission the D.G. Set at Indian Institute of Management Bodh Gaya premises within 14 (fourteen) days from the date of issuance of work order.
    9. The Contract will remain in force initially for a period of one year from the date of satisfactory commissioning of the D.G. Set at site. However, the contract is subject to termination at any time if the services are not found satisfactory or for any other reason whatsoever. The Contract may be renewed for further period at mutually agreed rates/charges and keeping other terms & conditions unchanged, depending on satisfactory services rendered by the supplier/contractor and requirement of the Indian Institute of Management Bodh Gaya.
    10. The deployment of operator for running the generator should comply with the labour legislation Act. and Minimum Wage Act of Govt. of India and Govt. of Bihar.
    11. The contractor will have to remove the D.G. Set from the Indian Institute of Management Bodh Gaya premises within 3 (Three) days from the date of termination or closure of the Contract at their own cost. Mending of any damage caused to the Indian Institute of Management Bodh Gaya property during taking the Generator out of the Indian Institute of Management Bodh Gaya premises will be done by the contractor to original finish, at their cost.
    12. Penalty Clause: In case of delay in installation/any major break-down of the D.G. Set requiring repairing time for more than two hours, an alternative interim arrangement should be made by the supplier/contractor immediately by providing a substitute Generator of identical capacity at no extra cost. For non-functioning of the D.G. Set or in the event of failure on the part of the contractor to provide an alternative interim generator of identical capacity, within two hours or during power failure/load shedding, penalty at double the pro-rata rate will be imposed and deducted from monthly bill for the generator.
    13. Terms of Payment of the bill: Monthly rental will be paid on the basis of successful running of the DG set during the month.
    14. Tender containing any condition leading to unknown/indefinite liability, are liable to be summarily rejected.
    15. Canvassing in connection with tenders is strictly prohibited and the tenders submitted by the suppliers/contractors who resort to canvassing will be liable for rejection.
    16. All taxes and duties, etc. or any other tax as applicable shall be payable by contractor and the Institute will not entertain any claim whatsoever in this respect. The rate quoted by the contractor should take care of all such taxes & duties etc.
    17. The Institute reserves the right to reject any or all the tenders without assigning any reason.

    Tender Process:

    Tender is invited in two parts i.e. (1) Qualifying Bid and (2) Financial Bid.     General Terms & Conditions:

    (i) Contract period: One year (from 1st January, 2017 to 31st December, 2017 on all 7 (days) in a week including Saturdays, Sundays and Holidays) which may be extended for a further period of one year subject to satisfactory performance and requirement of the Institute. Duty hours of the vehicle will be from 9.00 AM to 7.00 PM (10 hours per day) which is subject to change.

    (ii) The vehicle will ply inside the campus only and will run not more than 500 Kms per month. Beyond 500 Kms in a month, Rate per Km must be mentioned in the quoted rate by the Agency.

    (iii) During duty hours, the Vehicle should follow the schedule for parking of the vehicle and should remain under the control of Engineering Division/Transport Department of IIMC.

    (iv) In each case the monthly invoice of the said vehicle should be submitted within 7 (seven) days of the next month. Service Tax as applicable should be shown separately in your invoice.

    (v) While on duty the driver should keep with him the proper & up-to-date records of the vehicle, valid driving license.

    (vi) The courtesy and good behaviour on the part of the driver is important. Discourteous or careless driver shall be replaced on demand by the Institute.

    (vii) The Agency is solely responsible for all actions including payment of any type of claims arising out of infringement of rules, regulations, accident or any other unforeseen happening. In case, the vehicle is withdrawn for maintenance /repair/ breakdown, a substitute vehicle should be provided forthwith.

    (viii) Liability of the Agency: When the Institute engages a vehicle, all liabilities in respect of the vehicle and the driver including accident to the vehicle, injury to driver and the passengers travelling in vehicle shall rest with the Agency. The hiring authority has no responsibility whatsoever and will not entertain any claim in this regard under the provision of the law.

    (ix) The engagement and employment of driver and payment of wages as per existing provisions of various labour laws or regulations shall be deemed to be breach of this contract if not adhered to.

    (x) The Agency shall assign the job of driving of hired vehicles only to qualified, experienced, licensed drivers and also assume full responsibility for the safety and security of the users. The essential spares are to be stored in the vehicle for trouble free driving. IIM Calcutta shall have no direct or indirect liability arising out of negligent, rash and impetuous driving which is an offence under relevant section of IPC and any loss caused to IIM Calcutta will have to be suitably compensated by the Agency.

    (xi) Vehicle having commercial registration, shall be supplied to IIM Calcutta and taxes etc., due on such vehicles shall be liability of the Agency. The cost of lubricants, repairs, maintenance, taxes, insurance, etc. will be the Agency’s liability.

    (xii) The vehicle deployed during the contractual period at any point of time should be well maintained and in perfect running condition as per IIM Calcutta’s requirement with proper pollution check and valid pollution certificate.

    (xiii) Driver of the vehicle must be provided and maintain mobile phones. No extra charges would be paid by IIM Calcutta for the same.

    (xiv) In case of break down/servicing/repair, the Agency shall provide alternate vehicle of same model, failing which vehicle shall be hired from any other source/sources at the risk and cost of the Agency.

    (xv) The maintenance cost, charges of fuel (petrol/diesel), road tax, permit fee, passenger Tax, Border Tax, challans, salary of the driver, the overtime etc. are the responsibility of the Agency and should be paid by the Agency. Insurance: The provided vehicle must be fully and comprehensively insured covering the risk to the driver and all passengers also.

    (xvi) The Institute shall have absolutely no responsibility to pay any compensation for any accident occurred to any person/representative of the Agency during his to and fro journey and or while attending to the services of the Institute and no other charges whatsoever shall be payable by the Institute to the Agency.

    (xvii) The Institute shall have the liberty to enter into similar contract with any other Agency engaged in Car Rental Services parallelly without making any reference.

    (xviii) The rates will be inclusive of all taxes, i.e. cost of petrol/diesel, lubricants, driver’s salary & allowances etc.

    (xix) Payment will be made on monthly basis on submission of the bill (duly certified by the user and the Transport department, preferably within 30 working days from the date of submission of bill.

    (xx) No escalation/extra charges will be allowed over & above approved rate during the tenure of contract.

    (xxi) The Driver should be courteous to the users, maintain discipline, decorum, well dressed & should always carry a mobile phone with him. In the event of misbehaviour on the part of driver, IIM Calcutta may impose penalty as deemed fit on the Agency.

    (xxii) IIM Calcutta reserves the right to terminate the contract at any time without assigning any reason thereof by serving 30 days prior notice.

    (xxiii) Sub-contracting Not Allowed : The successful bidder shall not subcontract, transfer or assign the task to any other Agency without the previous written approval of IIM Calcutta. In case the Agency contravenes this condition, IIM Calcutta shall be entitled to place the contract elsewhere at the cost and risk of the Agency and all expenses borne on this account shall be recovered from him.

    (xxiv) Penalties: (1) In case of break-down of the vehicle, the same to be replaced by other vehicle in good condition immediately (maximum one hour from the time of break-down). Failure on the part of Agency to provide such replacement will attract imposition of penalty on pro-rata basis against each break-down. (2) IIM Calcutta also reserves the right to impose penalties for unsatisfactory services which may include: (a) Delayed arrival/report at the designated stop/place. (b) Misbehaviour with the users. (c) Violation of instructions given by IIM Calcutta. The final decision of the extent of penalty leviable on the Agency will rest with the Institute Authority and it is binding on the Agency.

    (xxv) Arbitration: All disputes shall be tried to be settled mutually my making references to conditions of contract documents or prevailing local practices etc., but if not settled mutually, shall be referred to arbitration. Such arbitration shall be governed by the provisions of the Indian Arbitration and Conciliation Act, 1996 or as amended from time to time. The venue for such arbitration will be in Kolkata. The award of the Arbitrator shall be final, conclusive and binding on all parties to the contract.

    3. Contractor liability for damage caused during installation work and imperfections noticed:
      If the contractor or his/her workmen or servants shall break, deface, injure or destroy any part of the building in which they may be working or building road, fence, enclosure, water pipe, cable, drain, electric or telephone posts or wires, trees, grass or grasslands or any Technical Equipment in the premises on which the work or any part of it as being executed, or if any defect, shrinkage or other faults appear in the work the contractor shall make good at his/her own expense, or in default, the indentor may get the same rectified and deduct the expense from any amount that may be than due or at any time thereafter may become due to the contractor.
    4. The contractor shall take insurance for his men while working at IIM Bodh Gaya site, against any injury, accidents death etc. Similarly the equipment, instruments, tools etc., belonging to the constrictor shall be insured against damage, loss, theft etc.
    5. Time: Time allowed for the execution of work is to be maintained strictly. Unless there is a compelling situation, extension of time will not be considered. Time is the essence of the contract.
    6. Price: Price must be quoted in rupees and is inclusive of VAT and transportation charges. Service tax as applicable.
    7. Delivery & Installation: Delivery of materials and installation at IIM Bodh Gaya must be done within 14 days from the date of issuance of work order. The rates should be inclusive of delivery and installation charges at IIM Bodh Gaya.
    8. Warranty: One year from the date of installation.
    9. Payment: Payment will be made after successful completion of the work & satisfactory certificate from IIM Bodh Gaya. The scope of work mentioned in the BOQ is indicative in nature and payment will be made based on actual quantities of work done at site.
    10. Security Deposit: 10% of the billed value will be retained as security deposit for a period of 1 year (defect liability period) from the date of completion of the work. The security deposit includes the Earnest Money Deposit (EMD).
    11. Earnest Money Deposit (EMD): At the rate equal to 2% of the offered value as per tender, by Demand Draft in favour of “Indian Institute Management Bodh Gaya” and payable at Kolkata. Earnest Money Deposits are to be submitted in the form of demand draft on any scheduled bank in separate envelope which will be opened first. Without proper EMD, no offers will be considered and opened. Under no circumstances, any other documents excepting Demand Draft/ Pay Order will be considered as valid EMD.
    12. Quality: Quality of the work is of utmost importance. This shall be adhered to in accordance with the provisions of relevant specifications and guidelines given in the relevant paragraphs of tender documents and/or as per the standard practice.
    13. Validity: The rate must be valid for three months from the date of tender.
    14. Risk Purchase: In case of supplier’s failure to deliver the ordered item(s) as per stipulated time schedule, IIM Bodh Gaya reserves the right to cancel the order by serving notice instantly and in such case, EMD deposited by contractor will be forfeited in the credit of IIM Bodh Gaya.
    15. Jurisdiction: All questions, disputes and/or differences arising under and out of, or in connection with the contact, if concluded, shall be referred to the High Court at Calcutta or any other court in the district of 24 Parganas (South).
