Notice inviting Tender and schedule of Events

Indian Institute of Management Calcutta, the CAT Centre for CAT 2018, invites sealed Bids in Two-Bid System (Part I - Technical Bid, Part II- Price Bid), from bonafide, experienced & reputed agencies/firms/companies for providing Advertisement Services for CAT 2018 for the work given below:

5 Tender submission Fee Rs. 5,000.00 ( Rupees Five thousand only) by Demand Draft in favour of Indian Institute of Management Calcutta, payable at Kolkata.
6 Earnest Money Deposit (EMD) Rs.4,00,000.00 (Rupees Four lakh only) by Demand Draft in favour of Indian Institute of Management Calcutta, payable at Kolkata. Tenders submitted without earnest money shall be rejected. The EMD of the unsuccessful bidders will be refunded without any interest after the award of the work. The EMD of the bidder is liable to be forfeited, if the bidder prematurely withdraws his bid or the successful bidder fails to take up the job or fails to deposit the Security Deposit. The EMD of the successful bidder will be returned upon the receipt of the Security Deposit in the form prescribed herein by the Institute.
7 Penalty Clause The work has to be executed on 29th July, 2018 as indicated in the tender document. In case of delay, beyond 29th July, 2018 upto 07 days, a penalty of Rs. 2,000/- per News Paper per day will be imposed. If the Agency unable to execute the work even after a delay of 07 days beyond 29th July, 2018, Security Deposit will be forfeited and work will be awarded to other party/agency at the cost and risk of Agency.
8 Security Deposit (SD)/ Performance Guarantee Security Deposit shall be 10% of the Contract Value. The successful agency will have to deposit a Performance Guarantee of 10% of the cost of order value which includes EMD in the form of Demand Draft of any Scheduled Bank in favor of Indian Institute of Management Calcutta within 07 days from receipt of Work Order which will be returned without interest after completion of the work and after settling all accounts with the Agency
9 Interest on Security Deposit No interest will be paid on any deposit
10 Release of Security Deposit The Security Deposit amount will be released after completion of the work and settlement of the bill.

12 Submission of Bid Documents Bids should be sent through Speed Post/ Registered Post/Courier Service by 12.00 noon on July 6, 2018 at the office of Senior Administrative Officer (Purchase), Indian Institute of Management Calcutta, Diamond Harbour Road,Joka, Kolkata – 700104. Please note that Bid Documents will NOT be accepted after 12.00 noon under any circumstances.
13 Opening of Bids PART- I : Technical bid shall be opened at 2.30 PM on July 6, 2018 in the presence of authorized attending representatives of Bidders, if any, at IIM Calcutta.
PART – II : Price Bid of the technically qualified bidders shall be opened at a later date which will be informed separately.
14 Essential Technical Requirement Bidder must have all statutory registrations like PAN, TAN, GST etc. as applicable from time to time with respect to this work.
15 Conditional Bids Conditional bids or Bids based on the process / basic schemes other than mentioned and / or not conforming to the technical specifications / requirements of the Bidding documents will not be considered.
16 Contract Agreement IF REQUIRED BY IIMC, the successful Bidder has to execute a contract Agreement with IIMC on a non-judicial stamp paper of Rs.100 (Rupees One Hundred only). The cost of stamp paper shall be borne by successful Bidder. IIMC reserves the right to amend the terms & conditions of contract after Mutual discussions and shall only be in writing.
17 Work and risk cost The Institute reserves the right to get the whole or part of the work/service executed by some other agency at the risk and cost of the agency, if it is found that the quality and/or the progress in respect of whole or part of the work/service is not satisfactory.
18 Arbitration All disputes regarding quality, specifications and rates shall be tried to be settled mutually by making references to conditions of contract documents or prevailing local practices etc., but if not settled mutually, shall be referred to arbitrator subject to Arbitration and Conciliation Act of 1996 and its amendments, modifications to-date. Arbitration cost to be shared equally by the owner and the agency. The venue of Arbitration shall be at Calcutta.
19 Authorization The agency shall submit to the Institute the names, designations and specimen signatures of the persons authorized by him/her for any related work.
20 Prices, Taxes & Duties The Bidder should quote firm prices/ rates inclusive of all applicable Taxes like GST etc. in the prescribed format.
21 Bid Validity Bid submitted by bidder shall remain valid for a period of 60 days from the date of opening of offer. Bidder shall not be entitled during this period to revoke or vary the content of Bid or any term thereof. In such case of making any variation subsequent to submission of bid at their own, the offer shall be treated as “REJECTED” and EMD shall be forfeited without any reference to the Bidder.
22 Rejection of Bid(s) IIMC reserves the right to reject any or all the tenders relating to the work under this Tender Document without assigning any reason whatsoever.
23 Assignment and sub contracting The agency shall not assign, sub-contract or sub-let the whole or any part of the contract in any manner.
24 Misconduct The agency shall keep IIMC indemnified from and against all personal and third party claims whatsoever arising out of any commission or omission by agency or his employees, or representatives as the case may be.
25 Payment of Bills Payments will be made as per the Institute norms.
26 Advance payment No advance payment/payment against proforma invoice will be made.
27 Bills Payment to the agency shall be made on submission of all bills, duly supported with all original copies/clipping of all editions and details of editions covered, of the advertisements/ newspapers released. Payments will be made within 30 working days of submission of bills provided the bills are complete and duly authenticated by the specified Officer(s) of IIMC.
28 Price to be quoted The Indian Institute of Management Calcutta is an autonomous body established by the Government of India. If the agencies have any special rates for Government of India Organization's/Autonomous Body/Academic Institutions, they may quote those rates accordingly.
Price should be quoted on the basis of base rates issued by the newspapers. The rate of taxes and discount etc. should be indicated clearly so as to arrive at net amount payable. The authorized signatory, signing the price bid, should attach proof of authorization of signing.
29 Force Majeure If the whole or any part of the performance by the Parties of any part of their respective obligations hereunder is prevented or delayed by causes, circumstances or events beyond the control of the Parties including delays due to floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government, custom barriers, or other causes of like character beyond the control of the Parties, then to the extent the Parties shall be prevented or delayed from performing all or any part of its obligations hereunder by reason thereof despite due diligence and reasonable efforts to do so notwithstanding such causes, circumstances or events, the Parties shall be excused from performance hereunder for so long as such causes, circumstances or events shall continue to prevent or delay such performance.
30.1 Taxes, Labour laws and other regulations The agency will be exclusively responsible to meet and comply with all legal requirements related to the work.
30.2 The agency shall accept and bear full and exclusive liability for the payment of any and all existing taxes of the Central or State Government or of any other authority with respect to the contract or any item sold or supplied pursuant thereto or anything done or service rendered pursuant thereto.
30.3 Any legal matter or issues arise and all court matters if arise for this contract are subjected in Kolkata Courts jurisdictions only.
31.1 Pre qualification requirements (Supporting documents are to be attached with Technical Bid) Agency to submit the documentary proof in support for the eligibility criteria indicated herein. A simple undertaking by the agency for any of the above points shall not be considered for the purpose of evaluation.
31.2 The applicant should be in ADVERTISING business for a minimum period of FIVE years as on 31/03/2018.(Please attach copy of Memorandum of Association & Article etc.) The right to accept the proof of business of the agency will rest with IIMC.
31.3 The Agency should have Indian Newspaper Society (INS) accreditation (Attach copy of proof).
31.4 The Agency should furnish a declaration stating that it has not been blacklisted by any Central/State Government/Public Sector Undertaking/Institute of Govt. of India. The false declaration will be liable for further action.
31.5 The agency should have executed the similar type of contract during the last five years as follows:
Three similar contracts of Rs.25 Lakh OR
Two similar works of Rs 40 Lakh OR
One similar work of Rs 75 Lakh

31.6 The applicant should have GST and PAN No as applicable to this contract from time to time. (Please submit the copies of relevant documents). Any other relevant registration like GST etc.
32 Bid format The bid shall be submitted in order as follows.
Sealed Envelope - 1 (Technical Bid) Copies to be submitted along with the Technical Bid document:
Technical Bid documents required as per tender document downloaded from IIMC website, signed and stamped on all pages by the authorised representative of the Bidder.
Bid document fee in the form of Demand Draft of Rs. 5,000.00 to be enclosed.
EMD in the form of Demand Draft of amount Rs. 4,00,000.00 to be enclosed.
Relevant experience as per Pre Qualification criteria
Previous contract value as per IIMC’s requirement
Copy of GST and PAN No. etc.
Any other information bidder would like to attach.

Sealed Envelope - 2 (Price Bid) Price bid documents downloaded from IIMC website, filled and signed and stamped.
Outer Envelope These two envelopes will be wrapped in an outer envelope addressed to "Senior Administrative Officer (Purchase), Indian Institute of Management Calcutta, Diamond Harbour Road, Joka, Kolkata 700104" duly super scribed on the top "Tender for Advertisement Services CAT 2018". The envelope should also bear the name and address of the Bidder.
33 System of Bid Evaluation Price BID of only those bidders who qualify in technical process will be opened at a subsequent date, which will be informed to qualified bidders separately.
34 Mathematical error During opening of price bids the total quoted amount will be declared. However, during calculation verification if there is any error found in total amount words will prevail over figures and the agency may also be called for clarifications. Rate will not be allowed to be changed in any case.
